Important notice: This document is a proposed revision for your review and does not constitute legal advice. Please have a Swiss-qualified advisor review before publishing, especially because you sell to the EU/UK.


1. Scope and Parties

1.1. These General Terms and Conditions ("GTC") govern the use of our website and the sale of products and services offered by Paper County (the "Seller") via www.papercounty.co to any individual or entity purchasing them (the "Purchaser").

1.2. By placing an order, the Purchaser confirms that they have read, understood, and agree to be bound by these GTC.

1.3. The Purchaser must be at least 18 years old (or the age of majority in their jurisdiction) and legally capable of entering into contracts. Use of our services is prohibited where unlawful.

1.4. The Seller may amend these GTC at any time. The version applicable to a purchase is the version in force at the time the order is placed.


2. Definitions (for clarity)

  • Business Day: Monday–Friday, excluding Swiss public holidays.
  • Consumer: A natural person acting for purposes outside their trade, business, or profession.
  • Custom Products: Items made to order, personalized, or produced upon request (e.g., cups, coasters, tote bags with custom designs).

3. Products and Availability

3.1. We offer stationery, lifestyle items (including glassware and tote bags), and customization services. Product images are illustrative; minor variations (e.g., color due to screen settings or handmade characteristics) may occur and are not defects.

3.2. All products are subject to availability. If an ordered item is unavailable after checkout, we will notify the Purchaser by email and offer (i) cancellation with refund, or (ii) an exchange or alternative of equal value.


4. Prices, Taxes, and Duties

4.1. Prices are shown in Swiss francs (CHF) and include applicable Swiss taxes unless stated otherwise. Shipping fees are calculated separately at checkout.

4.2. EU/UK Deliveries (DDP). For EU/UK customers, product prices at checkout include the required import VAT/duties and any carrier handling fees (Delivered Duty Paid). No additional charges are due upon delivery.

5. Orders and Contract Formation

5.1. The ordering process is completed when the Purchaser (i) submits required information, (ii) accepts these GTC, and (iii) pays the total amount due. Our email confirmation constitutes acceptance of the order and formation of the contract.

5.2. We may refuse or cancel orders that are incomplete, fraudulent, in payment default, or otherwise problematic (including if a processor declines a transaction). If payment has been captured, we will refund the amount for the refused order.

5.3. Order Changes/Cancellation Before Dispatch. After validation, changes are generally not possible. The Purchaser may request cancellation before dispatch; if accepted, we refund minus a CHF 7.00 cancellation fee to cover processing. We may waive or reduce this fee at our discretion—please email info@papercounty.co as soon as possible. [ACTION: CONFIRM] Keep the CHF 7 fee? Any exceptions?

5.4. Custom Products. Custom Products cannot be cancelled once production has started. Where feasible, a 24‑hour grace period from order placement applies for cancellation of Custom Products (e.g., cups, coasters, tote bags with custom designs).


6. Payment

6.1. We accept the payment methods shown at checkout (currently credit/debit cards, TWINT, and PayPal). Payments are processed via secure, encrypted gateways.

6.2. The currency of charge is CHF. Your card issuer or payment provider may apply exchange rates and fees.


7. Shipping & Delivery

7.1. Destinations. We ship to Switzerland, the EU, and the UK.

7.2. Processing Times. Orders are usually processed within 3–5 Business Days (or 4–6 Business Days for glass cups). During peak times, processing may take longer. 

7.3. Carriers and Transit Times. We use Swiss Post for dispatch from Switzerland. Indicative transit times after dispatch:

  • Switzerland: PostPac Economy (~2 Business Days) or PostPac Priority (~1 Business Day).
  • EU/UK: typically 4–8 Business Days, depending on destination and customs clearance.
    These timeframes are estimates only.

7.4. Shipping Options & Costs. Shipping fees depend on destination, weight, and chosen service (e.g., Standard, Priority Plus, Registered). Fees are calculated at checkout.

  • Switzerland: Free shipping on orders over CHF 55.
  • EU: Free registered shipping on orders over CHF 150 (or equivalent).
  • UK: Free registered shipping on orders over CHF 150 (or equivalent).

7.5. Fragile Handling Service. For delicate items (e.g., glass cups), an optional “Fragile” handling service is available (surcharge currently CHF 7.50). Parcels using this service are handled with extra care and benefit from insurance in accordance with the carrier’s then‑current terms. We always use appropriate inner packaging and padding.

7.6. Delays. Once handed to the carrier, delivery timing is outside our control. Delays do not entitle the Purchaser to damages or cancellation, without prejudice to mandatory consumer rights.

7.7. No‑receipt of Confirmation Email. If the Purchaser does not receive an order confirmation, they must contact us at info@papercounty.co.


8. Transfer of Risk and Title

8.1. Consumers (B2C). Title transfers upon full payment. Risk of loss/damage transfers only upon physical delivery to the Purchaser (or their designated recipient), in line with consumer protection principles.

8.2. Business Customers (B2B). Title transfers upon full payment. Risk transfers when we hand the goods to the carrier.

This section replaces the prior rule that risk transferred upon order acceptance, which is not consumer‑friendly and may conflict with applicable law.


9. Inspection on Delivery; Damage and Loss

9.1. The Purchaser must check the parcel upon delivery. If the parcel is visibly damaged, the Purchaser should refuse delivery or request the damage be recorded by the carrier and promptly inform us.

9.2. For concealed damage or missing items, the Purchaser must notify us within 3 days of delivery at info@papercounty.co, including the order number, photos of packaging and items, and a description. We will assist with carrier claims and provide a replacement or remedy where appropriate.

9.3. All products are inspected before shipment.


10. Incorrect Address / Undeliverable Parcels

10.1. If a parcel is returned to us due to an incorrect/incomplete address, refusal, or non‑collection, we will either:
(a) Reship upon payment of the additional shipping costs; or
(b) Refund the product price minus the original shipping cost, to the original payment method (unless store credit is expressly requested).


11. Right of Withdrawal & Returns

A. EU/UK Consumers (statutory right)

11.1. If you are an EU/UK Consumer, you have a 14‑day withdrawal period from the day of delivery, without giving reasons, except for Custom Products and other statutory exceptions (e.g., sealed goods not suitable for return once unsealed).
11.2. To exercise your right, contact info@papercounty.co with your order number and a clear statement. We will acknowledge receipt and provide return instructions.
11.3. You must send back the goods within 14 days from notifying us. You bear the direct cost of return unless we agree otherwise or the item was defective/misdescribed.
11.4. We will refund all payments received for the returned items, including the cheapest standard outbound shipping option (if charged), within 14 days of receiving the returned goods or of you supplying evidence of having sent them back, whichever is earlier. Refunds are made using the original payment method.

B. Switzerland & other non‑EU/UK Customers (contractual policy)

11.5. If you are not covered by the EU/UK statutory right, we offer a 7‑day return window from delivery. Contact info@papercounty.co for authorization before sending items back; unauthorized returns may be refused.
11.6. Returned items must be unused, in original packaging, and in resalable condition.
11.7. Unless the item is defective or we made an error, return shipping costs are borne by the Purchaser.
11.8. Upon receipt and inspection, we will refund eligible items to the original payment method, unless you expressly request store credit.

C. Custom Products

11.9. Custom Products are non‑returnable and non‑refundable, except in case of defects or our error.

12. Warranty and Conformity

12.1. We stand behind the quality of our products. Your statutory rights regarding defects apply and are not excluded by these GTC.
12.2. For handmade items, minor variations in color, placement, or finish are normal and not defects.
12.3. If you receive a defective or misdescribed product, contact us promptly with photos. We will remedy by repair, replacement, price reduction, or refund according to applicable law.

This section replaces the earlier statement that no items are covered by warranty, which may not align with Swiss/EU consumer law.


13. Gifts

13.1. Gifted items may be exchanged or returned for store credit, provided they are new, unopened, unused, and in original packaging, subject to the above return rules and any statutory rights.


14. Limitation of Liability

14.1. To the maximum extent permitted by law, the Seller is not liable for indirect, incidental, or consequential damages (including lost profits), or for delays caused by carriers or customs, except in cases of wilful misconduct or gross negligence.
14.2. Nothing in these GTC limits liability that cannot be limited under applicable law (e.g., for death or personal injury caused by negligence).


15. Intellectual Property

15.1. All content on www.papercounty.co (including images, text, designs, and logos) is owned by or licensed to the Seller and protected by intellectual property laws. No content may be reproduced or used without prior written consent.


16. Data Protection

16.1. The Seller is the data controller for personal data processed in connection with orders and website use.
16.2. Please see our Privacy Policy for details on purposes, legal bases, retention, international transfers, and your rights under the Swiss nFADP and (where applicable) the EU/UK GDPR.

17. Governing Law and Jurisdiction

17.1. These GTC are governed by Swiss law.
17.2. Exclusive jurisdiction lies with the courts of the Canton of Valais (Sion), except that Consumers may bring claims in the courts of their habitual residence where mandatory consumer protection rules so provide.
